{"id":654,"date":"2014-12-05T07:02:34","date_gmt":"2014-12-05T06:02:34","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?p=654"},"modified":"2018-05-28T10:23:46","modified_gmt":"2018-05-28T09:23:46","slug":"harcelement-moral-precision-des-regles-de-preuve","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/harcelement-moral-precision-des-regles-de-preuve\/","title":{"rendered":"Harc\u00e8lement moral: pr\u00e9cision des r\u00e8gles de preuve"},"content":{"rendered":"<h2 style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">La preuve du harc\u00e8lement moral par les seuls certificats m\u00e9dicaux n\u2019est pas suffisante. <\/span><\/strong><\/h2>\n<p><strong><a href=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/harcelement-moral-precision-des-regles-de-preuve\/\"><img decoding=\"async\" class=\"alignleft size-thumbnail wp-image-866\" src=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Harc\u00e8lement-moral-150x150.jpg\" alt=\"avocat harc\u00e8lement moral;Harc\u00e8lement moral;avocat sp\u00e9cialiste conseil harc\u00e8lement\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Harc\u00e8lement-moral-150x150.jpg 150w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Harc\u00e8lement-moral-267x267.jpg 267w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Harc\u00e8lement-moral-100x100.jpg 100w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/><\/a>(Cass. soc. 30 septembre 2014, N\u00b0 de pourvoi: 13-16436)<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La Cour de cassation pr\u00e9cise \u00e0 nouveau dans cette esp\u00e8ce, les r\u00e8gles de preuve en mati\u00e8re de harc\u00e8lement. <strong>Le juge ne doit pas se contenter d\u2019examiner tous les faits, il doit juger les faits dans leur ensemble. <\/strong>La nuance est d\u2019importance.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">L\u2019article L1154-1 du code du travail stipule que <em>\u00ab\u00a0le salari\u00e9 \u00e9tablit des faits qui permettent de pr\u00e9sumer l&#8217;existence d&#8217;un harc\u00e8lement.\u00a0\u00bb<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La seule obligation du salari\u00e9 est donc d\u2019\u00e9tablir la r\u00e9alit\u00e9 de faits pr\u00e9cis et concordants, \u00e0 charge pour le juge d\u2019appr\u00e9cier si ces \u00e9l\u00e9ments, <strong>pris dans leur ensemble<\/strong>, permettent de pr\u00e9sumer d\u2019existence d\u2019un harc\u00e8lement moral <em>(Cass. soc. 15 nov.2011, n\u00b010-10687). <\/em>Ainsi, la demande du salari\u00e9 peut \u00eatre \u00e9cart\u00e9e si celui-ci ne rapporte aucun fait.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Une fois que le salari\u00e9 a \u00e9tabli la mat\u00e9rialit\u00e9 des faits, le juge doit <em>\u00ab\u00a0appr\u00e9hender ces faits dans leur ensemble et rechercher s\u2019ils permettent de pr\u00e9sumer l\u2019existence d\u2019un harc\u00e8lement\u00a0\u00bb. <\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Dans le cas d\u2019esp\u00e8ce, une salari\u00e9e qui occupait les fonctions de responsable comptable a refus\u00e9 une modification de ses horaires de travail. En arr\u00eat-maladie, puis d\u00e9clar\u00e9e inapte \u00e0 son poste de travail par avis par le m\u00e9decin du travail, cette derni\u00e8re est par la suite licenci\u00e9e pour inaptitude \u00e0 son poste de travail et impossibilit\u00e9 de reclassement.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La salari\u00e9e saisit la juridiction prud\u2019homale de diverses demandes notamment de rappel de salaires au titre d\u2019heures suppl\u00e9mentaires et de harc\u00e8lement moral.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La Cour d\u2019appel la d\u00e9boute de ses demandes. Elle forme un pourvoi en cassation. Selon elle, les juges ont m\u00e9connu les dispositions de l\u2019article 1154-1 du code du travail, <em>\u00ab\u00a0en retenant que ni l&#8217;avis d&#8217;inaptitude du m\u00e9decin, ni les avis m\u00e9dicaux, qui font \u00e9tat de ce que la salari\u00e9e pr\u00e9sentait un \u00e9tat d\u00e9pressif s\u00e9v\u00e8re r\u00e9actionnel \u00e0 un conflit professionnel aigu et de ce que cet \u00e9tat n\u00e9cessitait un traitement psychoth\u00e9rapeutique et un traitement m\u00e9dicamenteux, ne seraient \u00e0 m\u00eame d&#8217;\u00e9tablir \u00e0 eux seuls la mat\u00e9rialit\u00e9 des faits constitutifs de harc\u00e8lement, alors qu&#8217;il lui appartenait de dire si, pris dans leur ensemble, les \u00e9l\u00e9ments mat\u00e9riellement \u00e9tablis, dont les certificats m\u00e9dicaux, laissaient pr\u00e9sumer l&#8217;existence d&#8217;un harc\u00e8lement moral\u00a0\u00bb.<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La cour de Cassation s\u2019inscrit dans le m\u00eame sens, puisqu\u2019elle rejette le pourvoi de la salari\u00e9e. Elle pr\u00e9cise qu\u2019aucun des \u00e9l\u00e9ments invoqu\u00e9s par la salari\u00e9e comme permettant de pr\u00e9sumer l&#8217;existence d&#8217;un harc\u00e8lement moral n&#8217;\u00e9tait mat\u00e9riellement \u00e9tabli, et que les documents m\u00e9dicaux ne pouvaient \u00eatre \u00e0 eux seuls de nature \u00e0 \u00e9tablir cette pr\u00e9somption<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Elle fait ainsi une application de sa jurisprudence. L\u2019examen du juge doit porter sur l\u2019ensemble des faits. <em>(Cass. soc. 24 sept. 2008, n\u00b006-46517\u00a0; Cass. soc. 24 sept.2008, n\u00b006-45747\u00a0; Cass. soc. 24 sept. 2008, n\u00b006-45579\u00a0; Cass. soc. 24 sept. 2008, n\u00b006-43-504). <\/em>Il convient de souligner que si le juge ne peut se fonder uniquement sur l\u2019alt\u00e9ration de la sant\u00e9. \u00c0 l\u2019inverse, il ne doit pas non plus n\u00e9gliger cet aspect des choses.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La preuve du harc\u00e8lement moral par les seuls certificats m\u00e9dicaux n\u2019est pas suffisante.
