l\u2019origine (licenciement, d\u00e9mission,\u00a0rupture conventionnelle du contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, etc.),\u00a0l\u2019employeur remet obligatoirement au salari\u00e9, un certificat de travail\u00a0qui atteste, notamment, de l\u2019emploi occup\u00e9 par le salari\u00e9 dans l\u2019entreprise, un re\u00e7u pour solde de tout compte et une attestation pour P\u00f4le Emploi indispensable pour faire valoir \u00e9ventuellement les droits \u00e0 l\u2019allocation ch\u00f4mage.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La d\u00e9livrance tardive de ces documents de fin de contrat cr\u00e9e un pr\u00e9judice au salari\u00e9 qui peut en demander r\u00e9paration.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La Cour de cassation a eu \u00e0 le pr\u00e9ciser lors d\u2019une affaire.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Un salari\u00e9 licenci\u00e9 avait contest\u00e9 son licenciement et \u00e9galement r\u00e9clam\u00e9 des dommages et int\u00e9r\u00eats pour remise tardive de son attestation p\u00f4le emploi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Dans cette affaire, si le certificat de travail avait bien \u00e9t\u00e9 remis au salari\u00e9 \u00e0 la fin de son contrat de travail, l\u2019attestation destin\u00e9e \u00e0 P\u00f4le emploi, qui avait d\u00fb \u00eatre corrig\u00e9e \u00e0 plusieurs reprises, ne lui avait \u00e9t\u00e9 remise que huit jours apr\u00e8s la fin du pr\u00e9avis.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">La Cour de cassation a eu \u00e0 pr\u00e9ciser que l\u2019attestation d\u2019employeur destin\u00e9e \u00e0 P\u00f4le emploi doit \u00eatre d\u00e9livr\u00e9e au salari\u00e9 sans d\u00e9lai. \u00c0 d\u00e9faut, elle consid\u00e8re que la remise tardive de ce document entra\u00eene n\u00e9cessairement un pr\u00e9judice pour le salari\u00e9.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Ainsi, \u00a0la remise tardive de l\u2019attestation p\u00f4le emploi entra\u00eene n\u00e9cessairement un pr\u00e9judice ouvrant droit \u00e0 l\u2019attribution de dommages et int\u00e9r\u00eats au profit du salari\u00e9, ceci peu important la faiblesse du d\u00e9lai ou l\u2019absence de preuve de pr\u00e9judice particulier.<\/span><\/p>\n<p><span style=\"color: #000000;\">R\u00e9f\u00e9rence\u00a0: <em>(<a style=\"color:
