{"id":25928,"date":"2020-03-20T12:37:30","date_gmt":"2020-03-20T11:37:30","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/?p=25928"},"modified":"2024-05-13T12:39:13","modified_gmt":"2024-05-13T11:39:13","slug":"decret-qui-assouplit-le-chomage-partiel","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/decret-qui-assouplit-le-chomage-partiel\/","title":{"rendered":"Un d\u00e9cret assouplit le ch\u00f4mage partiel"},"content":{"rendered":"\n\n\n<h2><u>Ch\u00f4mage partiel\u00a0:<\/u> les nouvelles dispositions du d\u00e9cret assouplit <img decoding=\"async\" class=\"alignright size-thumbnail wp-image-22507\" src=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2020\/03\/ch\u00f4mage-150x150.jpg\" alt=\"Ch\u00f4mage partiel\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2020\/03\/ch\u00f4mage-150x150.jpg 150w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2020\/03\/ch\u00f4mage-267x267.jpg 267w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2020\/03\/ch\u00f4mage-100x100.jpg 100w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/>le recours \u00e0 ce dispositif<\/h2>\n<p>Un projet de d\u00e9cret transmis le 17 mars 2020 \u00e0 la Commission nationale de la n\u00e9gociation collective de l\u2019emploi et de la formation professionnelle (CNNCEFP) pr\u00e9voit\u00a0 de reformer le dispositif du recours au ch\u00f4mage partiel en introduisant diff\u00e9rentes mesures d\u2019assouplissements.<\/p>\n<p>Dans le texte tel qu\u2019il figure \u00e0 ce jour dans le code du travail, il est pr\u00e9cis\u00e9 \u00e0 l\u2019\u2019article R 5122-1 du code du travail que\u00a0:<\/p>\n<p><em>\u00ab\u00a0L&#8217;employeur peut placer ses salari\u00e9s en position de ch\u00f4mage partiel lorsque l&#8217;entreprise est contrainte de r\u00e9duire ou de suspendre temporairement son activit\u00e9 pour l&#8217;un des motifs suivants :<\/em><\/p>\n<p><em>1\u00b0 La conjoncture \u00e9conomique ;<br \/>2\u00b0 Des difficult\u00e9s d&#8217;approvisionnement en mati\u00e8res premi\u00e8res ou en \u00e9nergie ;<br \/>3\u00b0 Un sinistre ou des intemp\u00e9ries de caract\u00e8re exceptionnel ;<br \/>4\u00b0 La transformation, restructuration ou modernisation de l&#8217;entreprise ;<br \/>5\u00b0 Toute autre circonstance de caract\u00e8re exceptionnel.\u00a0\u00bb<\/em><\/p>\n<p>Le projet de d\u00e9cret pr\u00e9voit d\u2019am\u00e9liorer la prise en charge de l\u2019\u00c9tat afin de couvrir 100 % des indemnisations vers\u00e9es aux salari\u00e9s par les entreprises dans la limite de 4,5 Smic.<\/p>\n<p>Dans le d\u00e9cret, il est \u00e9galement pr\u00e9vu d\u2019accorder un d\u00e9lai de 30 jours \u00e0 l\u2019employeur apr\u00e8s la mise en activit\u00e9 partielle pour en formuler les demandes d\u2019autorisation.<\/p>\n<p>En outre, il est envisag\u00e9 de prendre en compte la situation des salari\u00e9s en forfait et l\u2019allongement du d\u00e9lai pr\u00e9vu pour consulter le CSE et envoyer son avis \u00e0 l\u2019administration.<\/p>\n<p>\u00a0<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>Ch\u00f4mage partiel : Une demande d\u2019autorisation simplifi\u00e9e et r\u00e9troactive<\/strong><\/span><\/h3>\n<p><strong>\u00a0<\/strong><\/p>\n<p>L\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000030751738&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20170101\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">article L1522-1 du code du travail<\/a> pr\u00e9cisait que la mise en activit\u00e9 partielle devait \u00eatre pr\u00e9c\u00e9d\u00e9e d\u2019une autorisation. Il s\u2019agit d\u2019une demande pr\u00e9alable \u00e0 l\u2019administration avant la mise en place de ce dispositif.<\/p>\n<p>En effet, les textes pr\u00e9voient aujourd\u2019hui une d\u00e9rogation \u00e0 cette demande pr\u00e9alable.<\/p>\n<p>Ainsi, en cas de suspension d&#8217;activit\u00e9 due \u00e0 un sinistre ou \u00e0 des intemp\u00e9ries, l&#8217;employeur n\u2019est pas soumis \u00e0 la demande pr\u00e9alable. Il dispose d&#8217;un d\u00e9lai de 30 jours pour adresser r\u00e9troactivement sa demande par tout moyen conf\u00e9rant date certaine.<\/p>\n<p>Ce qui signifie que les demandes d\u2019autorisation pourront \u00eatre faites jusqu\u2019\u00e0 un mois apr\u00e8s le jour o\u00f9 l\u2019activit\u00e9 des salari\u00e9s a \u00e9t\u00e9 r\u00e9duite ou suspendue.<\/p>\n<p>\u00a0<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>Ch\u00f4mage partiel : <\/strong><\/span><span style=\"text-decoration: underline;\"><strong>Une dur\u00e9e maximum de 12 mois<\/strong><\/span><\/h3>\n<p>\u00a0<\/p>\n<p>Le d\u00e9lai a \u00e9galement \u00e9t\u00e9 modifi\u00e9.<\/p>\n<p>Actuellement, l&#8217;autorisation d&#8217;activit\u00e9 partielle peut \u00eatre accord\u00e9e pour une dur\u00e9e maximum de 6 mois. Elle pouvait \u00eatre renouvel\u00e9e sous certaines conditions.<\/p>\n<p>Le projet de d\u00e9cret envisage de rallonger cette dur\u00e9e. <strong>Ce dispositif pourrait d\u00e9sormais \u00eatre accord\u00e9 pour une dur\u00e9e maximum de 12 mois, <\/strong>renouvelables l\u00e0 encore.<\/p>\n<p>\u00a0<\/p>\n<h3><span style=\"text-decoration: underline;\"><strong>Une prise en charge plafonn\u00e9e \u00e0 4,5 Smic<\/strong><\/span><\/h3>\n<p>\u00a0<\/p>\n<p>Actuellement, l\u2019employeur est tenu d\u2019indemniser les salari\u00e9s \u00e0 hauteur d\u2019au moins 70 % de leur r\u00e9mun\u00e9ration brute, et m\u00eame \u00e0 100 % en cas de formation pendant la p\u00e9riode d\u2019activit\u00e9 partielle.
