De ce fait, un licenciement non motiv\u00e9 pourra \u00eatre jug\u00e9 sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p>Il convient de rappeler la situation ant\u00e9rieure.<\/p>\n<h3><strong><u>Petite rappel de la situation avant l\u2019ordonnance<\/u><\/strong><\/h3>\n<p style=\"text-align: justify;\">Il \u00e9tait \u00e9tabli aussi bien par la jurisprudence que par la loi que la lettre de licenciement fixe les limites du litige.<\/p>\n<p style=\"text-align: justify;\">Cette formule signifie qu\u2019elle doit indiquer les motifs <strong>objectifs, pr\u00e9cis et v\u00e9rifiables qui justifient la rupture. A d\u00e9faut, le licenciement sera jug\u00e9 sans cause r\u00e9elle et s\u00e9rieuse.<\/strong><\/p>\n<p style=\"text-align: justify;\">Autrement dit, si l&#8217;employeur, dans la lettre de licenciement, oublie de mentionner les motifs de la rupture ou donne des motifs impr\u00e9cis, il n&#8217;a plus aucun moyen de se d\u00e9fendre lors d&#8217;un \u00e9ventuel proc\u00e8s.<\/p>\n<p style=\"text-align: justify;\">L&#8217;obligation d&#8217;\u00e9noncer les motifs dans la lettre de licenciement concerne tous les licenciements, qu&#8217;ils aient un motif \u00e9conomique ou personnel, disciplinaire ou non article (L.\u00a01232-6, al.\u00a02).<\/p>\n<p style=\"text-align: justify;\">En l&#8217;absence d&#8217;\u00e9nonciation des motifs, le licenciement \u00e9tait n\u00e9cessairement sans cause r\u00e9elle et s\u00e9rieuse. A cet \u00e9gard, l&#8217;envoi ult\u00e9rieur d&#8217;une lettre motiv\u00e9e importe peu (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000007505842\" target=\"_blank\" rel=\"noopener\">Cass. soc., 23\u00a0janv. 2007, n\u00b0 05-43.428<\/a>)<\/p>\n<h3><strong><u>Ce que la reforme apporte<\/u><\/strong><\/h3>\n<p style=\"text-align: justify;\">Le nouvel article L 1235-2 du code du travail pr\u00e9voit que les motifs \u00e9nonc\u00e9s dans la lettre de licenciement peuvent, apr\u00e8s notification de celle-ci, \u00eatre pr\u00e9cis\u00e9s ou compl\u00e9t\u00e9s\u00a0:<\/p>\n<ul>\n<li>Soit par l\u2019employeur\u00a0;<\/li>\n<li>Soit \u00e0 la demande du salari\u00e9.<\/li>\n<\/ul>\n<p>Un d\u00e9cret viendrait pr\u00e9ciser les conditions d\u2019application de cette proc\u00e9dure.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019am\u00e9nagement de l\u2019obligation de motivation de la lettre de licenciement L\u2019ordonnance n\u00b0 2017-1387 du 22 septembre 2017 relative \u00e0 la pr\u00e9visibilit\u00e9 et la s\u00e9curisation des relations de travail met en place une proc\u00e9dure permettant de pr\u00e9ciser les motifs \u00e9nonc\u00e9s dans la lettre de licenciement, apr\u00e8s la notification de celle-ci.
