N\u2019ayant pas re\u00e7u ses documents de fin de contrat de travail, notamment l\u2019attestation p\u00f4le emploi, elle a saisi la juridiction prud\u2019homale pour demander des dommages et int\u00e9r\u00eats pour non d\u00e9livrance des documents de rupture.<\/p>\n<p style=\"text-align: justify;\">La Salari\u00e9e est d\u00e9bout\u00e9e par le Conseil de prud\u2019hommes et la Cour d\u2019appel de sa demande de dommages et int\u00e9r\u00eats pour la non d\u00e9livrance par l\u2019employeur de l\u2019attestation P\u00f4le emploi.<\/p>\n<p style=\"text-align: justify;\">Selon les juges de fond, la d\u00e9livrance de cette attestation ne s&#8217;imposait pas \u00e0 l&#8217;employeur puisque le salari\u00e9 d\u00e9missionnaire ne pouvait pas pr\u00e9tendre au versement d&#8217;allocations de ch\u00f4mage du fait de sa d\u00e9mission.<\/p>\n<p style=\"text-align: justify;\">La d\u00e9cision est censur\u00e9e par la cour de cassation. Les juges ne peuvent pas d\u00e9bouter un salari\u00e9 d\u00e9missionnaire de sa demande de dommages et int\u00e9r\u00eats pour non-d\u00e9livrance de l&#8217;attestation P\u00f4le emploi au motif que la rupture du contrat ne lui permet pas de b\u00e9n\u00e9ficier des allocations de ch\u00f4mage.<\/p>\n<p style=\"text-align: justify;\">La Cour de cassation au visa de l\u2019article R1234-9 du code du travail pr\u00e9cise que\u00a0:<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0<\/em><em>\u2026 selon ce texte, que l&#8217;employeur d\u00e9livre au salari\u00e9, au moment de l&#8217;expiration ou de la rupture du contrat de travail, les attestations et justifications qui lui permettent d&#8217;exercer ses droits aux prestations mentionn\u00e9es \u00e0 l&#8217;article L. 5421-2 du code du travail et transmet sans d\u00e9lai ces m\u00eames attestations \u00e0 P\u00f4le emploi ; que cette obligation s&#8217;applique dans tous les cas d&#8217;expiration ou de rupture du contrat de travail\u00a0\u00bb<\/em><em>.<\/em><\/p>\n<p style=\"text-align: justify;\">Partant, la Cour de cassation en d\u00e9duit que <em>\u00ab\u00a0cette obligation s\u2019impose \u00e0 l\u2019employeur pour toute rupture du contrat\u00a0\u00bb<\/em>, et cela m\u00eame en cas de d\u00e9mission.<\/p>\n<p style=\"text-align: justify;\">Enfin, il faut souligner que l\u2019employeur peut \u00eatre condamner \u00e0 des dommages et int\u00e9r\u00eats en cas de d\u00e9livrance tardive de l\u2019attestation p\u00f4le emploi si le salari\u00e9 prouve que cette carence lui a port\u00e9 un pr\u00e9judice.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans cette esp\u00e8ce, la Cour de cassation vient r\u00e9affirmer que l\u2019employeur a l\u2019obligation de remettre au salari\u00e9 sans pr\u00e9avis les documents de fin de contrat de travail.
