{"id":1767,"date":"2017-05-15T21:10:58","date_gmt":"2017-05-15T19:10:58","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?p=1767"},"modified":"2024-05-13T18:49:26","modified_gmt":"2024-05-13T17:49:26","slug":"insuffisance-professionnelle","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/insuffisance-professionnelle\/","title":{"rendered":"Pas d\u2019insuffisance professionnelle caract\u00e9ris\u00e9e en l\u2019absence de moyens"},"content":{"rendered":"<h2><strong>Pas d\u2019insuffisance professionnelle\u00a0caract\u00e9ris\u00e9e en l\u2019absence de moyens <em>(<\/em><\/strong><em>Cass. soc. 22-2-2017 n\u00b015-25.023)<\/em><\/h2>\n<p><em>\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\">Dans cette d\u00e9cision, la Cour de cassation pr\u00e9cise qu\u2019est d\u00e9pourvue de cause r\u00e9elle et s\u00e9rieuse, le licenciement pour insuffisance professionnelle d\u2019une salari\u00e9e lorsque celle-ci n&#8217;est pas imputable aux capacit\u00e9s de l&#8217;int\u00e9ress\u00e9e mais \u00e0 des absences de personnel au sein du bureau qu&#8217;elle dirigeait et au fait qu&#8217;elle a repris une activit\u00e9 \u00e0 temps partiel apr\u00e8s son cong\u00e9 de maternit\u00e9 (Cass. soc. 22-2-2017 n\u00b0 15-25.023 F-D).<\/p>\n<p style=\"text-align: justify;\">Cette d\u00e9cision a \u00e9t\u00e9 rendue \u00e0 l\u2019occasion du licenciement pour insuffisance professionnelle d\u2019une salari\u00e9e.<\/p>\n<p style=\"text-align: justify;\">Cette salari\u00e9e avait saisi le Conseil de Prud\u2019hommes pour contester son licenciement.<\/p>\n<p style=\"text-align: justify;\">Les juges du fond ont d\u00e9clar\u00e9 le licenciement sans cause r\u00e9elle et s\u00e9rieuse et ont condamn\u00e9 l\u2019employeur au paiement de dommages et int\u00e9r\u00eats.<\/p>\n<p style=\"text-align: justify;\">Pour les juges du fond, l\u2019insuffisance de r\u00e9sultat n\u2019\u00e9tait pas imputable aux capacit\u00e9s de l\u2019int\u00e9ress\u00e9, mais \u00e0 des absences de personnels au sein du bureau dont elle avait la responsabilit\u00e9 et au fait qu\u2019elle-m\u00eame, apr\u00e8s son cong\u00e9 maternit\u00e9 n&#8217;avait repris son activit\u00e9 qu&#8217;\u00e0 temps partiel. D\u00e8s lors, la faiblesse de ses r\u00e9sultats ne pouvait pas fonder un licenciement pour insuffisance professionnelle.<\/p>\n<p style=\"text-align: justify;\">Cette position des juges de fond est confirm\u00e9e par la Cour de cassation.<\/p>\n<p style=\"text-align: justify;\">Il convient de souligner que la Cour de cassation est constante sur sa position. <strong>L\u2019employeur ne peut licencier un salari\u00e9 pour insuffisance professionnelle s\u2019il ne lui fournit pas les moyens mat\u00e9riels et humains indispensables \u00e0 la bonne ex\u00e9cution de sa mission<\/strong> <em>(Cass. soc. 19-10-2010 n\u00b0 09-42.225 ; Cass. soc. 5-10-1989 n\u00b087-42.073).<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pas d\u2019insuffisance
