{"id":1692,"date":"2016-12-16T02:09:10","date_gmt":"2016-12-16T00:09:10","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?p=1692"},"modified":"2024-05-13T18:49:10","modified_gmt":"2024-05-13T17:49:10","slug":"referentiel-indemnite","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/referentiel-indemnite\/","title":{"rendered":"R\u00e9f\u00e9rentiel indicatif d&#8217;indemnisation"},"content":{"rendered":"<h2><span style=\"text-decoration: underline;\">Publication d\u2019un r\u00e9f\u00e9rentiel indicatif d&#8217;indemnisation et d\u2019un bar\u00e8me de l&#8217;indemnit\u00e9 forfaitaire de conciliation<\/span><\/h2>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">Deux d\u00e9crets\u00a0du 23 novembre 2016 concernant les contentieux relatifs aux licenciements ont \u00e9t\u00e9 publi\u00e9s au Journal officiel du 25 novembre 2016.<a href=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/referentiel-indemnite\/\"><img decoding=\"async\" class=\"alignright size-thumbnail wp-image-1703\" src=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/12\/bar\u00e8me-150x150.jpg\" alt=\"bar\u00e8me indemnit\u00e9\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/12\/bar\u00e8me-150x150.jpg 150w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/12\/bar\u00e8me-267x267.jpg 267w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/12\/bar\u00e8me-100x100.jpg 100w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/><\/a><\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Le d\u00e9cret n\u00b0 2016-1581 du 23 novembre 2016 portant fixation du r\u00e9f\u00e9rentiel indicatif d&#8217;indemnisation pr\u00e9vu \u00e0 l&#8217;article L. 1235-1 du code du travail est publi\u00e9.<\/span><\/li>\n<li><span style=\"color: #000000;\">Le second d\u00e9cret (d\u00e9cret n\u00b0 2016-1582) a\u00a0pour objet de modifier le bar\u00e8me de conciliation, afin de le mettre en coh\u00e9rence avec le r\u00e9f\u00e9rentiel indicatif auquel se r\u00e9f\u00e8re le juge prud&#8217;homal \u00e0 d\u00e9faut d&#8217;accord entre les parties.<\/span><\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">Le bar\u00e8me de l\u2019indemnit\u00e9 forfaitaire de conciliation est revu \u00e0 la hausse pour le rendre plus coh\u00e9rent.<\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">L\u2019article L1235-1 du code du travail pr\u00e9voit qu\u2019\u00a0<span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>\u00ab\u00a0en cas de litige, <\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>lors de la conciliation pr\u00e9vue \u00e0 l&#8217;article <\/i><\/span><\/span><span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&amp;idArticle=LEGIARTI000006901457&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>L. 1411-1<\/i><\/span><\/span><\/a><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>, l&#8217;employeur et le salari\u00e9 peuvent convenir ou le bureau de conciliation et d&#8217;orientation proposer d&#8217;y mettre un terme par accord. Cet accord pr\u00e9voit le versement par l&#8217;employeur au salari\u00e9 d&#8217;une indemnit\u00e9 forfaitaire dont le montant est d\u00e9termin\u00e9, sans pr\u00e9judice des indemnit\u00e9s l\u00e9gales, conventionnelles ou contractuelles, en r\u00e9f\u00e9rence \u00e0 un bar\u00e8me fix\u00e9 par d\u00e9cret en fonction de l&#8217;anciennet\u00e9 du salari\u00e9\u00a0\u00bb.<\/i><\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">L\u2019indemnit\u00e9 forfaitaire de conciliation va de 2 mois de salaire pour un salari\u00e9 ayant moins d\u2019un an d\u2019anciennet\u00e9, jusqu\u2019\u00e0 24 mois de salaire \u00e0 partir de 30 ans d\u2019anciennet\u00e9. <\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">Il convient de souligner que l\u2019indemnit\u00e9 forfaitaire s\u2019ajoute aux indemnit\u00e9s l\u00e9gales, conventionnelles ou contractuelles dues par ailleurs (notamment indemnit\u00e9s de licenciement et de pr\u00e9avis, le cas \u00e9ch\u00e9ant indemnit\u00e9 compensatrice de non-concurrence). <\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">Le bar\u00e8me est fix\u00e9 comme suit\u00a0:<\/span><\/p>\n<table style=\"width: 356.2px;
