En date du 18 janvier 2011, une convention de rupture est homologu\u00e9e par l\u2019administration. Le salari\u00e9 \u00e9voquant l\u2019absence d\u2019entretien avait saisi le conseil de Prud\u2019hommes pour en demander la nullit\u00e9. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Pour rappel, la loi exige la tenue d\u2019au moins un entretien avant la conclusion d&#8217;une rupture conventionnelle. A d\u00e9faut, l&#8217;une ou l&#8217;autre partie peut demander la nullit\u00e9 de la convention de rupture\u00a0(article L1237-12 du code du travail).<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">La Cour de cassation vient pr\u00e9ciser la charge de la preuve de l\u2019entretien.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Dans un arr\u00eat du 1<\/span><\/span><sup><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">er<\/span><\/span><\/sup><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"> d\u00e9cembre 2016, sous le visa des articles L. 1237-12 du code du travail et 1315, devenu 1353 du code civil, elle pr\u00e9cise que <\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>\u00ab\u00a0si le d\u00e9faut du ou des entretiens pr\u00e9vus par le premier de ces textes, relatif \u00e0 la conclusion d\u2019une convention de rupture, entra\u00eene la nullit\u00e9 de la convention, c\u2019est \u00e0 celui qui invoque cette cause de nullit\u00e9 d\u2019en \u00e9tablir l\u2019existence\u00a0\u00bb<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">.
