La proc\u00e9dure de constatation par le m\u00e9decin du travail de la proc\u00e9dure d\u2019inaptitude physique est r\u00e9form\u00e9e. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">D\u00e9sormais en cas d\u2019inaptitude, les m\u00eames r\u00e8gles s\u2019appliquent que l\u2019inaptitude r\u00e9sulte d\u2019un accident de travail ou d\u2019une maladie professionnelle. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-size: medium; color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\">Il convient de souligner que les nouvelles r\u00e8gles n\u2019entrent pas en vigueur de suite. Leur mise en \u0153uvre n\u00e9cessite des d\u00e9crets d\u2019application \u00e0 para\u00eetre au plus tard le 1<\/span><sup><span style=\"font-family: 'Times New Roman', serif;\">er<\/span><\/sup><span style=\"font-family: 'Times New Roman', serif;\"> janvier 2017.<\/span><\/span><\/p>\n<h2 align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\"><i>\u00ab<strong>Le m\u00e9decin du travail ne peut constater l&#8217;inaptitude m\u00e9dicale du salari\u00e9 \u00e0 son poste de travail que s&#8217;il a r\u00e9alis\u00e9<\/strong> : <\/i><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\"><i>1\u00b0 <\/i><i><u><b>Une \u00e9tude de ce poste<\/b><\/u><\/i><i> ; <\/i><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\"><i>2\u00b0 <\/i><i><u><b>Une \u00e9tude des conditions de travail dans l&#8217;entreprise<\/b><\/u><\/i><i> ; <\/i><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\"><i>3\u00b0 <\/i><i><u><b>Deux examens m\u00e9dicaux de l&#8217;int\u00e9ress\u00e9 espac\u00e9s de deux semaines<\/b><\/u><\/i><i>, accompagn\u00e9s, le cas \u00e9ch\u00e9ant, des examens compl\u00e9mentaires. <\/i><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><i><span style=\"color: #000000; font-family: 'Times New Roman', serif; font-size: medium;\">Lorsque le maintien du salari\u00e9 \u00e0 son poste de travail entra\u00eene un danger imm\u00e9diat pour sa sant\u00e9 ou sa s\u00e9curit\u00e9 ou celles des tiers ou lorsqu&#8217;un examen de pr\u00e9-reprise\u00a0a eu lieu dans un d\u00e9lai de trente jours au plus, l&#8217;avis d&#8217;inaptitude m\u00e9dicale peut \u00eatre d\u00e9livr\u00e9 en un seul examen\u00a0\u00bb<\/span><\/i><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-size: medium; color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\">A titre de rappel, il faut souligner que <\/span><span style=\"font-family: 'Times New Roman', serif;\">l&#8217;inaptitude s&#8217;appr\u00e9cie \u00ab\u00a0\u00e0 la date \u00e0 laquelle elle a \u00e9t\u00e9 constat\u00e9e\u00a0\u00bb par le m\u00e9decin du travail, une \u00e9volution ult\u00e9rieure \u00e9tant sans influence<\/span><span style=\"font-family: 'Times New Roman', serif;\"><i>.<\/i><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">A ce jour, il ressort que le m\u00e9decin du travail peut d\u00e9clarer un salari\u00e9 inapte, apr\u00e8s 2 examens m\u00e9dicaux espac\u00e9s de 2 semaines accompagn\u00e9s, si n\u00e9cessaire, d&#8217;examens compl\u00e9mentaires.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Un salari\u00e9 peut \u00eatre d\u00e9clar\u00e9 inapte \u00e0 un seul examen si le maintien \u00e0 son poste de travail entra\u00eene un danger imm\u00e9diat pour sa sant\u00e9 ou sa s\u00e9curit\u00e9 ou pour celles de tiers, ou s&#8217;il a b\u00e9n\u00e9fici\u00e9 d&#8217;une visite de pr\u00e9-reprise dans les 30 jours pr\u00e9c\u00e9dents.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">La d\u00e9cision du m\u00e9decin du travail est subordonn\u00e9e \u00e0 une \u00e9tude de poste et des conditions de travail dans l\u2019entreprise.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span style=\"font-family: 'Times New Roman', serif;\">Il convient de souligner que le classement du salari\u00e9 en invalidit\u00e9 2<\/span><sup><span style=\"font-family: 'Times New Roman', serif;\">e<\/span><\/sup><span style=\"font-family: 'Times New Roman', serif;\"> cat\u00e9gorie par la s\u00e9curit\u00e9 sociale n\u2019exon\u00e8re pas l&#8217;employeur de faire constater r\u00e9guli\u00e8rement l&#8217;<\/span><span style=\"font-family: 'Times New Roman', serif;\">inaptitude<\/span><span style=\"font-family: 'Times New Roman', serif;\"> du salari\u00e9 \u00e0 son poste par le m\u00e9decin du travail. <\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">C\u2019est pourquoi, lorsque le licenciement du salari\u00e9 sera prononc\u00e9 sur le seul motif que le salari\u00e9 a \u00e9t\u00e9 plac\u00e9 en invalidit\u00e9, celui-ci est nul<\/span><\/span> <span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>(<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>Cass. soc., 13\u00a0janv. 1998, n\u00b0 95-45.439<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>)<\/i><\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Le licenciement du salari\u00e9 est \u00e9galement nul s&#8217;il est prononc\u00e9 apr\u00e8s un seul examen m\u00e9dical ne constatant pas l&#8217;existence d&#8217;un danger imm\u00e9diat <\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>(<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>Cass. soc. 4-6-2002 n\u00b0 00-42.873\u00a0; <\/i><\/span><\/span><i> <\/i><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>16-12-2010 n\u00b0 09-66.954<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>).<\/i><\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Lorsque le salari\u00e9 \u00e9tait en arr\u00eat de travail, la date du premier examen m\u00e9dical marque la fin de la suspension du contrat de travail.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Il en r\u00e9sulte que le salari\u00e9 doit continuer \u00e0 travailler entre les 2 examens. Si l\u2019employeur le lui interdit, il doit maintenir sa r\u00e9mun\u00e9ration (<\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>Cass. soc. 15-7-1998 n\u00b0 96-40.768 : <\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>RJS 10\/98 n\u00b0 1202<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i> ; <\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>12-7-2006 n\u00b0 04-46.290<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>)<\/i><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">. <\/span><\/span><\/span><\/p>\n<h2><span style=\"font-size: medium; color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><u><b>2- Les modifications introduites par la loi travail<\/b><\/u><\/span><\/span><\/h2>\n<p align=\"JUSTIFY\"><span style=\"font-size: medium; color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\">A compter du 1<\/span><sup><span style=\"font-family: 'Times New Roman', serif;\">er<\/span><\/sup><span style=\"font-family: 'Times New Roman', serif;\"> janvier 2017, ou de la date de publication du d\u00e9cret d&#8217;application s&#8217;il para\u00eet avant, le m\u00e9decin du travail d\u00e9clare le salari\u00e9 inapte \u00e0 son poste de travail s&#8217;il constate, en cours d&#8217;ex\u00e9cution du contrat de travail ou \u00e0 l&#8217;issue d&#8217;un arr\u00eat de travail ayant n\u00e9cessit\u00e9 un examen m\u00e9dical de reprise, qu&#8217;aucune mesure d&#8217;am\u00e9nagement, d&#8217;adaptation ou de transformation du poste de travail occup\u00e9 n&#8217;est possible et que l&#8217;\u00e9tat de sant\u00e9 du travailleur justifie un changement de poste. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">L\u2019apport le plus int\u00e9ressant concerne les conditions pr\u00e9alables \u00e0 cette d\u00e9claration. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">La nouvelle proc\u00e9dure instaur\u00e9e par la loi Travail est compos\u00e9e de 4 \u00e9tapes\u00a0:<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Une \u00e9tude pr\u00e9alable de la situation du salari\u00e9 aliment\u00e9e par des \u00e9changes entre le m\u00e9decin du travail, l\u2019employeur et le salari\u00e9<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Un entretien entre le m\u00e9decin du travail et le salari\u00e9<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">L\u2019envoi par le m\u00e9decin du travail de ses conclusions \u00e9crites \u00e0 l\u2019employeur<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">La mise en \u0153uvre par l\u2019employeur de l\u2019avis d\u2019inaptitude physique ou sa contestation, en cas de d\u00e9saccord avec les propositions du m\u00e9decin du travail<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Le d\u00e9cret d\u2019application pr\u00e9cisera l\u2019articulation entre les diff\u00e9rentes \u00e9tapes.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-size: medium; color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><br \/>\nQu\u2019elle soit d\u2019origine professionnelle ou non professionnelle, actuellement la constatation de l\u2019inaptitude physique entra\u00eene des cons\u00e9quences diff\u00e9rentes pour l\u2019employeur ou le salari\u00e9 en cas de reclassement. Comme cela a \u00e9t\u00e9 soulign\u00e9 plus haut, la loi Travail a unifi\u00e9 ce r\u00e9gime.<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">D\u00e9sormais, le r\u00e9gime juridique attach\u00e9 \u00e0 la constatation de l\u2019inaptitude physique s\u2019applique au salari\u00e9 qu\u2019il ait \u00e9t\u00e9 d\u00e9clar\u00e9 inapte en cours d\u2019ex\u00e9cution de son contrat de travail on \u00e0 l\u2019issue d\u2019un arr\u00eat de travail.<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">La loi a autoris\u00e9 le m\u00e9decin du travail \u00e0 dispenser l\u2019employeur de son obligation de reclassement pr\u00e9alable lorsque le maintien du salari\u00e9 pr\u00e9sente un risque grave pour sa sant\u00e9. Aucune diff\u00e9rence n\u2019est faite selon que l\u2019inaptitude est d\u2019origine professionnelle ou non.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Actuellement, lorsque l\u2019employeur veut reclasser le salari\u00e9 en cas d\u2019inaptitude professionnelle, il doit au pr\u00e9alable consulter les d\u00e9l\u00e9gu\u00e9s du personnel, et si sa recherche s\u2019av\u00e8re infructueuse, en avertir le salari\u00e9 par \u00e9crit. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">D\u00e9sormais, la consultation des d\u00e9l\u00e9gu\u00e9s du personnel sera \u00e9galement requise en cas d\u2019inaptitude physique ayant une origine non professionnelle.<\/span><\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Les propositions de reclassement faites au salari\u00e9 doivent r\u00e9unir les conditions suivantes\u00a0:<\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">\u00catre appropri\u00e9 aux capacit\u00e9s du salari\u00e9<\/span><\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Tenir compte de l\u2019avis exprim\u00e9 par les d\u00e9l\u00e9gu\u00e9s du personnel<\/span><\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">\u00catre conforme aux conclusions \u00e9crites du m\u00e9decin du travail<\/span><\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">\u00catre aussi comparable que possible \u00e0 l\u2019emploi pr\u00e9c\u00e9demment occup\u00e9 ( article L1226-2-1 du code du travail).<\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La\u00a0loi du Travail n\u00b02016-1088 du 8 ao\u00fbt 2016 modifie les r\u00e8gles applicables en mati\u00e8re d\u2019inaptitude physique du salari\u00e9.
