href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000033125153&amp;fastReqId=463947579&amp;fastPos=1\" rel=\"nofollow\">Cass. soc. 14 septembre 2016, n\u00b015-15943<\/a><\/i>), la cour de cassation pr\u00e9cise l\u2019\u00e9tendue de la protection du cong\u00e9 maternit\u00e9.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Elle \u00e9nonce que la p\u00e9riode de protection contre la rupture du contrat de travail de quatre semaines suivant le cong\u00e9 de maternit\u00e9 n\u2019est suspendue que par la prise des cong\u00e9s pay\u00e9s suivant imm\u00e9diatement le cong\u00e9 maternit\u00e9.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Il convient \u00e0 cet effet de revenir sur l\u2019\u00e9tendue de la protection telle qu\u2019elle figure dans le code du travail.<\/span><\/span><\/span><\/p>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><u><b>La protection l\u00e9gale du cong\u00e9 maternit\u00e9<\/b><\/u><\/span><\/span><\/span><\/h2>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">En application de l\u2019article L. 1225-4, alin\u00e9a 1, du code du travail,\u00a0<i>\u00ab aucun employeur ne peut rompre le contrat de travail d\u2019une salari\u00e9e lorsqu\u2019elle est en \u00e9tat de grossesse m\u00e9dicalement constat\u00e9 et pendant l\u2019int\u00e9gralit\u00e9 des p\u00e9riodes de suspension du contrat de travail auxquelles elle a droit au titre du cong\u00e9 de maternit\u00e9, qu\u2019elle use ou non de ce droit, ainsi que pendant les quatre semaines suivant l\u2019expiration de ces p\u00e9riodes \u00bb.<\/i><\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Il en r\u00e9sulte qu\u2019\u00e0 partir du moment o\u00f9 l\u2019employeur est inform\u00e9 de la grossesse, par la salari\u00e9e ou par tout autre moyen, ce dernier ne peut rompre le contrat de travail que s\u2019il justifie d\u2019une faute grave non li\u00e9e \u00e0 la grossesse, ou\u00a0\u00e0 l\u2019impossibilit\u00e9 de maintenir le contrat de travail pour un motif \u00e9tranger \u00e0 la grossesse ou \u00e0 l\u2019accouchement.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Depuis l\u2019entr\u00e9e en vigueur de la loi \u00b02016-1088 du 8 ao\u00fbt 2016 dite Loi travail, la p\u00e9riode de protection de la salari\u00e9e qui reprend son travail \u00e0 l\u2019issue de son cong\u00e9 de maternit\u00e9 est pass\u00e9e de 4 semaines \u00e0\u00a010 semaines\u00a0(<a style=\"color: #000000;\" href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000029334564&amp;cidTexte=LEGITEXT000006072050\" rel=\"nofollow\">article L.1225-4-1 du code du travail<\/a>).<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Il convient d\u2019ailleurs de souligner que cette protection sp\u00e9cifique avait \u00e9t\u00e9 \u00e9tendue au p\u00e8re par la loi du 4 ao\u00fbt 2014, qui b\u00e9n\u00e9ficie d\u00e9sormais \u00e9galement d\u2019une p\u00e9riode de protection de 10 semaines \u00e0 compter de la naissance de son enfant.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">En cons\u00e9quence, si l\u2019employeur prononce un\u00a0licenciement\u00a0ou\u00a0rompt son contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e\u00a0de mani\u00e8re anticip\u00e9e pour un autre motif, il s&#8217;expose \u00e0 la nullit\u00e9 du licenciement\u00a0<i>(Cass. Soc., 30 avr. 2003, n\u00b0 00-44.811;\u00a0<\/i><i>Cass. Soc., 15 oct. 200, n\u00b0 01-44.503<\/i><i>;\u00a0<\/i><i>Cass. Soc., 12 mai 2004, n\u00b0 02-43.261<\/i><i>).<\/i><\/span><\/span><\/span><\/p>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><u><b>La sanction<\/b><\/u><\/span><\/span><\/span><\/h2>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Lorsque le licenciement est nul, la salari\u00e9e a droit \u00e0 une r\u00e9int\u00e9gration dans son emploi ou, \u00e0 d\u00e9faut, dans un emploi \u00e9quivalent.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Il en r\u00e9sulte qu&#8217;en cas d&#8217;annulation du licenciement d&#8217;une salari\u00e9e en \u00e9tat de grossesse en application des dispositions du code du travail, sa r\u00e9int\u00e9gration doit \u00eatre ordonn\u00e9e si elle le demande. Cette r\u00e9int\u00e9gration doit \u00eatre faite dans son emploi, ou \u00e0 d\u00e9faut, dans un emploi \u00e9quivalent\u00a0<i>(<\/i><i>Cass. soc. 30-4-2003 n\u00b0 00-44.811<\/i>\u00a0<i>;\u00a0<\/i><i>15-10-2003 n\u00b0 01-44.503<\/i><i>).<\/i><\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">La salari\u00e9e peut alors pr\u00e9tendre au paiement d&#8217;une somme correspondant \u00e0 la r\u00e9paration de la totalit\u00e9 du pr\u00e9judice subi entre son licenciement et sa r\u00e9int\u00e9gration ou la date de son refus si elle renonce finalement \u00e0 la r\u00e9int\u00e9gration demand\u00e9e\u00a0<i>(<\/i><i>Cass. soc. 17-2-2010 n\u00b0 08-45.640\u00a0<\/i>, dans la limite du montant des salaires dont elle a \u00e9t\u00e9 priv\u00e9e\u00a0<i>(Cass. soc. 30-9-2010 n\u00b0 08-44.340)<\/i>.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Une jurisprudence ancienne pr\u00e9cise qu\u2019il\u00a0importe peu que l&#8217;int\u00e9ress\u00e9e retrouve un emploi, mieux r\u00e9mun\u00e9r\u00e9, aussit\u00f4t apr\u00e8s son licenciement: l&#8217;employeur doit n\u00e9anmoins lui verser le salaire qu&#8217;elle aurait per\u00e7u jusqu&#8217;\u00e0 l&#8217;expiration de la p\u00e9riode de protection.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Si la salari\u00e9e\u00a0ne demande pas sa r\u00e9int\u00e9gration,\u00a0l&#8217;employeur doit lui verser une\u00a0indemnit\u00e9\u00a0\u00e9gale au salaire qu&#8217;elle aurait per\u00e7u pendant la p\u00e9riode couverte par la nullit\u00e9, c&#8217;est-\u00e0-dire la p\u00e9riode comprise entre la date d&#8217;\u00e9viction de l&#8217;entreprise et l&#8217;expiration de la p\u00e9riode de protection de 10 semaines.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">La salari\u00e9e b\u00e9n\u00e9ficie en outre des indemnit\u00e9s de rupture (indemnit\u00e9 l\u00e9gale ou conventionnelle de licenciement et indemnit\u00e9 de pr\u00e9avis) et d&#8217;une indemnit\u00e9 au moins \u00e9gale \u00e0 6 mois de salaire r\u00e9parant int\u00e9gralement le pr\u00e9judice subi du fait du caract\u00e8re illicite du licenciement\u00a0<i>(<\/i><i>Cass. soc. 17-12-2002 n\u00b0 00-44.660 :<\/i>\u00a0\u00a0<i>RJS 3\/03 n\u00b0 337<\/i>\u00a0<i>;\u00a0<\/i><i>15-1-2014 n\u00b0 12-24.824 :\u00a0<\/i>\u00a0<i>RJS 3\/14 n\u00b0 215<\/i><i>).<\/i><\/span><\/span><\/span><\/p>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><u><b>L\u2019arr\u00eat de la Cour de cassation du\u00a014 septembre 2016<\/b><\/u><\/span><\/span><\/span><\/h2>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Dans l\u2019affaire soumise \u00e0 la cour de cassation, une salari\u00e9e a \u00e9t\u00e9 engag\u00e9e \u00e0 compter du 1<sup>er<\/sup>\u00a0juin 2003 en qualit\u00e9 de responsable commercial adjoint.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Elle a \u00e9t\u00e9 ensuite en cong\u00e9 maternit\u00e9 du 11 d\u00e9cembre 2009 au 6 ao\u00fbt 2010. Par lettre du\u00a020 mai 2010, la soci\u00e9t\u00e9 lui a fait savoir qu&#8217;elle mettait en \u0153uvre un projet de restructuration impliquant la suppression de vingt-six emplois dont le sien, qu&#8217;un plan de sauvegarde de l&#8217;emploi (PSE) avait \u00e9t\u00e9 soumis au comit\u00e9 d&#8217;entreprise et que figurait en annexe du PSE la liste des postes disponibles propos\u00e9s en reclassement au sein de l&#8217;entreprise et du groupe, que deux postes pouvaient lui convenir et qu&#8217;elle disposait d&#8217;un d\u00e9lai de quinze jours pour se porter candidate.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">Elle a \u00e9t\u00e9 dispens\u00e9e d\u2019activit\u00e9 par son employeur \u00e0 partir du 6 ao\u00fbt 2010 avant d\u2019\u00eatre licenci\u00e9e le 27 septembre suivant pour motif \u00e9conomique.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">La salari\u00e9e saisit le conseil de prud\u2019hommes pour demander la nullit\u00e9 du licenciement, ainsi qu\u2019une demande de r\u00e9int\u00e9gration, un rappel de salaires, ainsi que des dommages et int\u00e9r\u00eats.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">La salari\u00e9e arguait que le licenciement a \u00e9t\u00e9 prononc\u00e9 en violation de la p\u00e9riode de protection laquelle avait, selon elle, pour point de d\u00e9part la fin de la p\u00e9riode de dispense d\u2019activit\u00e9.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><strong><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">La Cour d\u2019appel d\u00e9boute la salari\u00e9e de ses demandes.<\/span><\/span><\/span><\/strong><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">La Cour de cassation rejette le pourvoi en pr\u00e9cisant que\u00a0<i>\u00ab la p\u00e9riode de protection de quatre semaines suivant le cong\u00e9 de maternit\u00e9 n\u2019est suspendue que par la prise des cong\u00e9s pay\u00e9s suivant imm\u00e9diatement le cong\u00e9 de maternit\u00e9, son point de d\u00e9part \u00e9tant alors report\u00e9 \u00e0 la date de reprise du travail <\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><i>par la salari\u00e9e \u00bb<\/i>. <strong>D\u00e8s lors, il n\u2019est pas possible de diff\u00e9rer cette p\u00e9riode pour un motif autre que les cong\u00e9s pay\u00e9s.<\/strong><\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Grossesse \u2013 maternit\u00e9 \u2013 cong\u00e9 maternit\u00e9 et protection de la salari\u00e9e A travers un arr\u00eat rendu le 14 septembre 2016\u00a0(Cass. soc. 14 septembre 2016, n\u00b015-15943), la cour de cassation pr\u00e9cise l\u2019\u00e9tendue de la protection du cong\u00e9 maternit\u00e9.
