Toutefois, dans certains cas, le point de d\u00e9part de l\u2019anciennet\u00e9 peut ne pas correspondre \u00e0 cette date d\u2019entr\u00e9e dans l\u2019entreprise.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Ainsi, <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">1)<\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><b>Dans le cas de transmission d\u2019entreprise\u00a0<\/b><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">: L&#8217;article\u00a0L.\u00a01224-1 du Code du travail\u00a0 impose la transmission de plein droit des contrats en cours au moment de la modification juridique de l&#8217;employeur, a pour effet de sauvegarder l&#8217;anciennet\u00e9 acquise chez le c\u00e9dant.\u00a0 L\u2019anciennet\u00e9 du salari\u00e9 est donc maintenue.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">2)<\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\"><b>Lorsqu\u2019un CDD succ\u00e8de \u00e0 un CDI<\/b><\/span><\/span><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">\u00a0: L\u2019article L.\u00a01243-11 du Code du travail pr\u00e9voit que si un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9 succ\u00e8de imm\u00e9diatement \u00e0 un CDD, le salari\u00e9 conserve l&#8217;anciennet\u00e9 qu&#8217;il a acquise au terme du contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e.\u00a0 <\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">3)\u00a0\u00a0\u00a0\u00a0\u00a0 <b>Le cas du contrat temporaire<\/b>\u00a0: Lorsqu\u2019une entreprise utilisatrice poursuit la mission d\u2019un salari\u00e9 temporaire au-del\u00e0 de son contrat, ce salari\u00e9 est r\u00e9put\u00e9 li\u00e9 \u00e0 l&#8217;entreprise utilisatrice par un contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e. Dans cette situation, l\u2019anciennet\u00e9 de ce salari\u00e9 est appr\u00e9ci\u00e9e au 1<sup>er<\/sup> jour de sa mission au sein de l&#8217;entreprise utilisatrice.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Toutefois, dans le cas o\u00f9 le salari\u00e9 a travaill\u00e9 chez un m\u00eame employeur avec plusieurs contrats de travail qui sont s\u00e9par\u00e9s entre eux par des p\u00e9riodes d&#8217;interruption, l&#8217;anciennet\u00e9 \u00e0 prendre en compte est celle du dernier contrat de travail, sauf disposition contraire de la convention collective ou du contrat de travail.<\/span><\/span><\/p>\n<h2 align=\"JUSTIFY\"><strong><span style=\"text-decoration: underline;\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">2-\u00a0Le contentieux sur l\u2019anciennet\u00e9\u00a0: comment prouver son anciennet\u00e9<\/span><\/span><\/span><\/strong><\/h2>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">En cas de litige, il convient en premier lieu de se conformer au contrat de travail ou la convention collective. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Ainsi, certaines conventions collectives ou contrat de travail contiennent des clauses de reprises de l\u2019anciennet\u00e9 du salari\u00e9.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Il convient en outre de signaler que le salari\u00e9 peut n\u00e9gocier lors de la signature de son contrat une reprise de l\u2019anciennet\u00e9.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Que faire si la date d\u2019entr\u00e9e du salari\u00e9 est diff\u00e9rente de celle figurant sur le bulletin de salaire\u00a0?<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">La Cour de cassation dans sa d\u00e9cision du 21 septembre 2011 (n\u00b0 de pourvoi\u00a0 09-72054) a pr\u00e9cis\u00e9 que la date d\u2019anciennet\u00e9 figurant sur le bulletin de salaire du salari\u00e9, et qui ne correspond pas \u00e0 la date d\u2019entr\u00e9e du salari\u00e9 dans l\u2019entreprise vaut pr\u00e9somption de reprise d\u2019anciennet\u00e9. Elle a admis que\u00a0: <i>\u00ab\u00a0Qu\u2019en se d\u00e9terminant ainsi, alors que la date d\u2019anciennet\u00e9 figurant dans le bulletin de paie vaut pr\u00e9somption de reprise d\u2019anciennet\u00e9 sauf \u00e0 l\u2019employeur \u00e0 rapporter la preuve contraire, la cour d\u2019appel, qui n\u2019a pas recherch\u00e9 comme il lui \u00e9tait demand\u00e9 si des mentions figurant dans les bulletins de paie ne faisaient pas pr\u00e9sumer l\u2019anciennet\u00e9 revendiqu\u00e9e par le salari\u00e9, a priv\u00e9 sa d\u00e9cision de base l\u00e9gale\u00a0\u00bb. <\/i><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'Times New Roman', serif; color: #000000;\"><span style=\"font-size: medium;\">Il est \u00e0 voir dans le m\u00eame sens la d\u00e9cision de la cour de cassation du 29 mai 2013, n\u00b0 de pourvoi 12-12895.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La question relative \u00e0 la reprise d\u2019anciennet\u00e9 du salari\u00e9 est importante.
