Le salari\u00e9 doit prouver le pr\u00e9judice qu\u2019il subit lors de la non remise ou la remise tardive de bulletins de paie ou du certificat de travail.<\/p>\n<p style=\"text-align: justify;\">Les faits sont les suivants\u00a0: un salari\u00e9 a saisi le Conseil de prud&#8217;hommes aux fins de remise, sous astreinte, de certificat de travail et de bulletins de paie, lesquels ont \u00e9t\u00e9 remis lors de l&#8217;audience de conciliation. Le salari\u00e9 a demand\u00e9 par ailleurs la condamnation de l\u2019employeur au paiement de dommages et int\u00e9r\u00eats en r\u00e9paration de cette remise tardive.<\/p>\n<p style=\"text-align: justify;\">Il arguait que la non remise de ces documents lui causait n\u00e9cessairement un pr\u00e9judice qui devait \u00eatre r\u00e9par\u00e9 par le juge. Le Conseil de prud\u2019hommes l\u2019a d\u00e9bout\u00e9 de sa demande. Les juges retenaient que le salari\u00e9 ne rapportait aucun \u00e9l\u00e9ment justifiant le pr\u00e9judice qu&#8217;il aurait subi.<\/p>\n<p style=\"text-align: justify;\">Le salari\u00e9 s\u2019est alors pourvu en cassation.<\/p>\n<p style=\"text-align: justify;\">La Cour de cassation rejette le pourvoi. Elle retient que <em>\u00ab\u00a0l&#8217;existence d&#8217;un pr\u00e9judice et l&#8217;\u00e9valuation de celui-ci rel\u00e8vent du pouvoir souverain d&#8217;appr\u00e9ciation des juges du fond ; que le conseil de prud&#8217;hommes, qui a constat\u00e9 que le salari\u00e9 n&#8217;apportait aucun \u00e9l\u00e9ment pour justifier le pr\u00e9judice all\u00e9gu\u00e9\u00a0\u00bb.<\/em><\/p>\n<p style=\"text-align: justify;\">Cette d\u00e9cision de la Cour de cassation semble marquer la fin de la pr\u00e9somption de pr\u00e9judice en cas de non remise du certificat de travail. Le salari\u00e9 a donc int\u00e9r\u00eat \u00e0 \u00e9tayer sa demande en d\u00e9montrant le pr\u00e9judice qu\u2019il a subi.<\/p>\n<p style=\"text-align: justify;\">Il convient toutefois de souligner que la d\u00e9cision de la Cour de cassation ne concernait pas le cas de non d\u00e9livrance de l\u2019attestation p\u00f4le emploi pour l\u2019assurance ch\u00f4mage.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>D\u00e9faut de remise de bulletins de paie ou de certificat de travail\u00a0: le salari\u00e9 doit prouver le pr\u00e9judice La Cour de\u00a0 cassation dans une d\u00e9cision rendue le 16 avril 2015 (Soc. 13 avr. 2016, FS-P+B+R, n\u00b0 14-28.293) vient modifier sa position sur la question.
