{"id":1523,"date":"2016-04-10T19:26:12","date_gmt":"2016-04-10T17:26:12","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?p=1523"},"modified":"2024-05-13T18:44:19","modified_gmt":"2024-05-13T17:44:19","slug":"inaptitude-salarie-reclassement","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/inaptitude-salarie-reclassement\/","title":{"rendered":"Inaptitude du salari\u00e9 : il appartient \u00e0 l\u2019employeur de justifier de l\u2019impossibilit\u00e9 de reclassement"},"content":{"rendered":"<h2 style=\"text-align: justify;\">Inaptitude du salari\u00e9\u00a0: il appartient \u00e0 l\u2019employeur de justifier de l\u2019impossibilit\u00e9 de reclassement, qu\u2019importe l\u2019attitude du salari\u00e9 (Cour de cassation 31 mars 2016, n\u00b0 14-19618)<\/h2>\n<p><a href=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/inaptitude-salarie-reclassement\/\" rel=\"attachment wp-att-1522\"><img decoding=\"async\" class=\"alignright size-thumbnail wp-image-1522\" src=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/04\/reclassement-du-salari\u00e9-150x150.jpg\" alt=\"reclassement du salari\u00e9 inapte m\u00e9dical\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/04\/reclassement-du-salari\u00e9-150x150.jpg 150w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/04\/reclassement-du-salari\u00e9-267x267.jpg 267w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2016\/04\/reclassement-du-salari\u00e9-100x100.jpg 100w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/><\/a>En cas d\u2019inaptitude constat\u00e9 du salari\u00e9, il appartient \u00e0 l\u2019employeur de reclasser le salari\u00e9.<\/p>\n<p style=\"text-align: justify;\">En effet, l\u2019article L1226-2 et L1226-10 du Code du travail pr\u00e9voient que\u00a0 lorsqu\u2019un salari\u00e9 est d\u00e9clar\u00e9 par le m\u00e9decin du travail inapte \u00e0 reprendre l&#8217;emploi qu&#8217;il occupait pr\u00e9c\u00e9demment, l&#8217;employeur est tenu de lui proposer un autre emploi\u00a0:<\/p>\n<ul>\n<li style=\"text-align: justify;\">appropri\u00e9 \u00e0 ses capacit\u00e9s, compte tenu des conclusions \u00e9crites du m\u00e9decin du travail et des indications qu&#8217;il formule sur l&#8217;aptitude du salari\u00e9 \u00e0 exercer l&#8217;une des t\u00e2ches existantes dans l&#8217;entreprise\u00a0;<\/li>\n<li style=\"text-align: justify;\">et aussi comparable que possible \u00e0 l&#8217;emploi pr\u00e9c\u00e9demment occup\u00e9, au besoin par la mise en \u0153uvre de mesures telles que mutations, transformations de poste de travail ou am\u00e9nagement du temps de travail.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">La cour de cassation pr\u00e9cise la port\u00e9e de cette obligation de reclassement mise \u00e0 la charge du salari\u00e9 dans\u00a0 cette esp\u00e8ce.<\/p>\n<p style=\"text-align: justify;\">Une salari\u00e9e engag\u00e9e en qualit\u00e9 de caissi\u00e8re, puis promue chef caissi\u00e8re est victime d\u2019un accident de travail. A l\u2019issue de deux examens m\u00e9dicaux, elle est d\u00e9clar\u00e9e inapte \u00e0 son poste par le m\u00e9decin du travail le 17 novembre 2011. Elle est licenci\u00e9e le 8 f\u00e9vrier 2012 pour inaptitude et impossibilit\u00e9 de reclassement.<\/p>\n<p style=\"text-align: justify;\">La salari\u00e9e licenci\u00e9e a saisi le Conseil de Prud\u2019hommes pour faire condamner l\u2019employeur pour non-respect de l\u2019obligation de reclassement et pour licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p style=\"text-align: justify;\">La salari\u00e9e est d\u00e9bout\u00e9e de sa demande de dommages et int\u00e9r\u00eat pour licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p style=\"text-align: justify;\">La Cour d\u2019appel retient que la salari\u00e9e ne d\u00e9montre pas que la soci\u00e9t\u00e9 faisait partie d&#8217;un groupe de soci\u00e9t\u00e9s au sein duquel son employeur aurait d\u00fb tenter de la reclasser. Elle rel\u00e8ve par ailleurs qu&#8217;apr\u00e8s avoir refus\u00e9 les postes administratifs qui lui \u00e9taient propos\u00e9s, la soci\u00e9t\u00e9 ne pouvant envisager son reclassement en magasin o\u00f9 n&#8217;existaient que trois cat\u00e9gories de postes non compatibles avec les restrictions \u00e9nonc\u00e9es par le m\u00e9decin du travail. En cons\u00e9quence, la salari\u00e9e se trouvait mal fond\u00e9e \u00e0 pr\u00e9tendre que son employeur aurait manqu\u00e9 \u00e0 son obligation de reclassement \u00e0 son \u00e9gard.<\/p>\n<p style=\"text-align: justify;\">La Cour de cassation n\u2019est pas de cet avis. Elle retient que peu importe la position de la salari\u00e9e, il appartient \u00e0 l&#8217;employeur de justifier de l&#8217;impossibilit\u00e9 de reclassement, le cas \u00e9ch\u00e9ant au sein d&#8217;entreprises dont les activit\u00e9s, l&#8217;organisation ou le lieu d&#8217;exploitation lui permettent d&#8217;effectuer la permutation de tout ou partie du personnel, la cour d&#8217;appel, qui, inversant la charge de la preuve, n&#8217;a pas caract\u00e9ris\u00e9 l&#8217;absence d&#8217;un tel groupe, dont l&#8217;existence \u00e9tait invoqu\u00e9e par cette salari\u00e9e.
