La Cour de cassation a retenu que l\u2019employeur \u00e9tait tenu \u00e0 une\u00a0obligation\u00a0de\u00a0s\u00e9curit\u00e9\u00a0de\u00a0r\u00e9sultat\u00a0en mati\u00e8re de protection de la sant\u00e9 et de la\u00a0s\u00e9curit\u00e9\u00a0des salari\u00e9s en vertu du contrat de travail le liant \u00e0 ses salari\u00e9s. Ainsi,\u00a0dans la pratique, l\u2019employeur ne peut s\u2019exempter de sa responsabilit\u00e9 en d\u00e9montrant son absence de faute ou qu\u2019il avait pris toutes les mesures propres \u00e0 faire cesser le risque. Le r\u00e9sultat suffit \u00e0 engager sa responsabilit\u00e9.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">La Cour de cassation se r\u00e9f\u00e8re ainsi \u00e0 l&#8217;obligation\u00a0de\u00a0s\u00e9curit\u00e9\u00a0pour de nombreuses th\u00e9matiques. Le non respect de cette\u00a0obligation\u00a0permet, par exemple en cas d&#8217;accident de travail ou de maladie professionnelle la reconnaissance de la faute inexcusable de l&#8217;employeur\u00a0et au niveau du contrat de travail, elle justifie la prise d&#8217;acte du salari\u00e9 qui pourra obtenir la requalification de sa prise d&#8217;acte en licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">Il ressort que le champ d\u2019application de cette obligation de s\u00e9curit\u00e9 de r\u00e9sultat \u00e9tait tr\u00e8s large.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">L\u2019arr\u00eat du 25 novembre 2015 semble marquer un changement dans l\u2019appr\u00e9hension de cette notion.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">Dans cette affaire,\u00a0un pilote d&#8217;Air France reprochait \u00e0 la compagnie a\u00e9rienne de n&#8217;avoir pas pris les mesures n\u00e9cessaires d\u2019accompagnement des salari\u00e9s apr\u00e8s les attentats du 11 septembre 2001.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">Ayant \u00e9t\u00e9 t\u00e9moin des attentats, il estimait que son employeur n&#8217;avait pas assur\u00e9 le suivi post-traumatique des salari\u00e9s expos\u00e9s \u00e0 cet \u00e9v\u00e9nement. Le 24 avril 2006, alors qu&#8217;il partait rejoindre son bord pour un vol, il a \u00e9t\u00e9 pris d&#8217;une crise de panique qui a donn\u00e9 lieu \u00e0 un arr\u00eat de travail. Le pilote a alors saisi en 2008 la juridiction prud&#8217;homale pour obtenir la condamnation de son\u00a0employeur\u00a0\u00e0 lui payer des dommages-int\u00e9r\u00eats pour manquement \u00e0 son\u00a0obligation\u00a0de\u00a0s\u00e9curit\u00e9\u00a0apr\u00e8s les attentats du 11 septembre 2001.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">Le salari\u00e9 est d\u00e9bout\u00e9 par les juges du fond. Pour les juges, l\u2019employeur avait r\u00e9agi correctement au stress post-traumatique. Il avait mis en place les mesures n\u00e9cessaires, notamment en assurant pour le salari\u00e9 et l\u2019\u00e9quipage une pr\u00e9sence jour et nuit et en les orientant \u00e9ventuellement vers des\u00a0<\/span><\/span><strong><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\"><b>consultations psychiatriques.<\/b><\/span><\/span><\/strong><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">\u00a0Les juges ont par ailleurs soulign\u00e9 que le salari\u00e9 a \u00e9t\u00e9 d\u00e9clar\u00e9\u00a0<\/span><\/span><strong><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\"><b>apte \u00e0 4 reprises<\/b><\/span><\/span><\/strong><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">\u00a0lors de visites m\u00e9dicales entre 2002 et 2005 et qu\u2019il a\u00a0<\/span><\/span><strong><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\"><b>exerc\u00e9 ses fonctions sans difficult\u00e9<\/b><\/span><\/span><\/strong><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">\u00a0jusqu\u2019en avril 2006.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">Le salari\u00e9 se pourvoit en cassation. La Cour de cassation s\u2019aligne sur la position des juges du fond. Elle retient que\u00a0<i>: \u00ab\u00a0Mais attendu que ne m\u00e9conna\u00eet pas l&#8217;obligation<\/i>\u00a0<i>l\u00e9gale lui imposant de prendre les mesures n\u00e9cessaires pour assurer la\u00a0s\u00e9curit\u00e9<\/i>\u00a0<i>et prot\u00e9ger la sant\u00e9 physique et mentale des travailleurs, l&#8217;employeur<\/i>\u00a0<i>qui justifie avoir pris toutes les mesures pr\u00e9vues par les articles L. 4121-1 et L. 4121-2 du code du travail\u00a0\u00bb.\u00a0<\/i>Les articles visent les mesures de pr\u00e9vention concernant la sant\u00e9 et la s\u00e9curit\u00e9 des salari\u00e9s.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><strong><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">Ainsi, lorsque l\u2019employeur d\u00e9montre avoir respect\u00e9 les dispositions pr\u00e9vues par le code du travail en mati\u00e8re de d\u2019hygi\u00e8ne et de s\u00e9curit\u00e9 des salari\u00e9s, il pourra s\u2019exon\u00e9rer de sa responsabilit\u00e9, contrairement \u00e0 la position ant\u00e9rieure de la Cour de cassation.<\/span><\/span><\/span><\/strong><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #333300;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: large;\">(1):\u00a0<i>(Cass. soc., 28\u00a0f\u00e9vr. 2002, n\u00b0 99-18.389, n\u00b0 837<\/i>\u00a0<i>;\u00a0Cass. soc., 28\u00a0f\u00e9vr. 2002, n\u00b0 00-10.051<\/i>\u00a0<i>;\u00a0Cass. soc., 28\u00a0f\u00e9vr. 2002, n\u00b0 00-11.793<\/i>\u00a0<i>;<\/i>\u00a0<i>Cass. soc., 28\u00a0f\u00e9vr. 2002, n\u00b0 99-21.255<\/i>\u00a0<i>;<\/i>\u00a0<i>Cass. soc., 28\u00a0f\u00e9vr. 2002, n\u00b0 99-17.201<\/i>\u00a0<i>; Cass. soc., 28\u00a0f\u00e9vr. 2002, n\u00b0 00-13.172<\/i>)<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: 'Times New Roman', serif;\"><span style=\"font-size: medium;\">\u00a0<\/span><\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Obligation de s\u00e9curit\u00e9 de r\u00e9sultat\u00a0: vers une inflexion de la position de la Cour de cassation.
