{"id":1388,"date":"2015-10-07T21:02:05","date_gmt":"2015-10-07T20:02:05","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?p=1388"},"modified":"2024-05-13T18:39:42","modified_gmt":"2024-05-13T17:39:42","slug":"demission-et-rupture-conventionnelle","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/demission-et-rupture-conventionnelle\/","title":{"rendered":"Effet d\u2019une d\u00e9mission suivi d\u2019une rupture conventionnelle"},"content":{"rendered":"<p align=\"JUSTIFY\">Le salari\u00e9 peut dans certains cas se r\u00e9tracter lorsqu\u2019il d\u00e9missionne (voir en ce sens\u00a0: <span style=\"color: #0000ff;\"><span style=\"color: #000000;\"><i>Cass. soc., 25\u00a0avr. 2001, n\u00b0 99-42.901<\/i><\/span><\/span><i>\u00a0; <\/i><span style=\"color: #0000ff;\"><span style=\"color: #000000;\"><i>Cass. soc., 5\u00a0d\u00e9c. 2012, n\u00b0 11-14.440<\/i><\/span><\/span><i>, <\/i><span style=\"color: #0000ff;\"><span style=\"color: #000000;\"><i>Cass. soc., 26\u00a0sept. 2002, n\u00b0 00-45.684<\/i><\/span><\/span><i>).<\/i><\/p>\n<p align=\"JUSTIFY\">En mati\u00e8re de rupture conventionnelle, la cour de cassation a admis que \u00ab\u00a0<i>lorsque le contrat de travail a \u00e9t\u00e9 rompu par l&#8217;exercice par l&#8217;une ou l&#8217;autre des parties de son droit de r\u00e9siliation unilat\u00e9rale, la signature post\u00e9rieure d&#8217;une rupture conventionnelle vaut renonciation commune \u00e0 la rupture pr\u00e9c\u00e9demment intervenue \u00bb (Cass. soc., 3 mars 2015, n\u00b0 13-20.549).<\/i><\/p>\n<p align=\"JUSTIFY\">La Cour de cassation admettait la possibilit\u00e9 pour le salari\u00e9 de renoncer \u00e0 la rupture du contrat pourtant d\u00e9j\u00e0 intervenue, que ce soit via un licenciement ou une d\u00e9mission, en concluant par la suite une rupture conventionnelle.<\/p>\n<p align=\"JUSTIFY\"><img decoding=\"async\" class=\"alignleft size-thumbnail wp-image-1391\" src=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/10\/d\u00e9mission-150x150.jpg\" alt=\"lettre de d\u00e9mission suivi d'une rupture conventionnelle\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/10\/d\u00e9mission-150x150.jpg 150w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/10\/d\u00e9mission-267x267.jpg 267w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/10\/d\u00e9mission-100x100.jpg 100w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/>Dans l\u2019esp\u00e8ce \u00e0 commenter, la Cour de cassation apporte une autre pr\u00e9cision. Le simple fait pour le salari\u00e9 ayant d\u00e9mission d\u2019\u00eatre convoqu\u00e9 \u00e0 un entretien en vue de conclure une rupture conventionnelle ne vaut pas renonciation commune des parties \u00e0 cette d\u00e9mission.<\/p>\n<p align=\"JUSTIFY\">Les faits sont les suivants\u00a0: Une salari\u00e9e a \u00e9t\u00e9 engag\u00e9e le 10 janvier 2010 en qualit\u00e9 d&#8217;auxiliaire de vie par contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e \u00e0 temps partiel.<\/p>\n<p align=\"JUSTIFY\">L\u2019employeur avait le 25 novembre 2010 demand\u00e9 \u00e0 son expert-comptable d\u2019\u00e9tablir des documents de rupture du contrat de travail \u00e0 la suite de la d\u00e9mission de la salari\u00e9e le 30 novembre 2010.<\/p>\n<p align=\"JUSTIFY\">Le 09 d\u00e9cembre 2010, l\u2019employeur a convoqu\u00e9 la salari\u00e9e \u00e0 un entretien fix\u00e9 au 20 d\u00e9cembre 2010 en vue d\u2019une rupture conventionnelle homologu\u00e9e du contrat de travail. La salari\u00e9e ne s\u2019est pas pr\u00e9sent\u00e9e.<\/p>\n<p align=\"JUSTIFY\">Elle saisit la juridiction prud\u2019homale de diverses demandes, entre autre d\u2019une r\u00e9siliation judiciaire de son contrat de travail.<\/p>\n<p align=\"JUSTIFY\">La salari\u00e9e est d\u00e9bout\u00e9e de sa demande.<\/p>\n<p align=\"JUSTIFY\">Saisi par un pourvoi, la Cour de cassation pr\u00e9cise que\u00a0: <i>\u00ab\u00a0post\u00e9rieurement \u00e0 la d\u00e9mission de la salari\u00e9e, celle-ci avait \u00e9t\u00e9 convoqu\u00e9e par l&#8217;employeur \u00e0 un entretien, auquel elle ne s&#8217;\u00e9tait pas pr\u00e9sent\u00e9e, en vue d&#8217;une rupture conventionnelle qui n&#8217;avait pas \u00e9t\u00e9 sign\u00e9e, la cour d&#8217;appel, motivant sa d\u00e9cision, a pu en d\u00e9duire l&#8217;absence de renonciation \u00e0 la rupture du contrat de travail qui r\u00e9sultait de la d\u00e9mission de la salari\u00e9e\u00a0\u00bb.<\/i><\/p>\n<p align=\"JUSTIFY\">Ainsi, le fait pour la salari\u00e9e de n\u2019avoir pas sign\u00e9e la rupture conventionnelle, ne permet pas de d\u00e9duire la renonciation commune des parties \u00e0 la d\u00e9mission de la salari\u00e9e.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le salari\u00e9 peut dans certains cas se r\u00e9tracter lorsqu\u2019il d\u00e9missionne (voir en ce sens\u00a0: Cass. soc., 25\u00a0avr. 2001, n\u00b0 99-42.901\u00a0; Cass. soc., 5\u00a0d\u00e9c. 2012, n\u00b0 11-14.440, Cass. soc., 26\u00a0sept. 2002, n\u00b0 00-45.684).
