{"id":1368,"date":"2015-08-05T08:30:58","date_gmt":"2015-08-05T07:30:58","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?p=1368"},"modified":"2016-06-07T08:37:35","modified_gmt":"2016-06-07T06:37:35","slug":"rupture-conventionnelle-2","status":"publish","type":"post","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/rupture-conventionnelle-2\/","title":{"rendered":"Rupture conventionnelle: une indemnit\u00e9 insuffisante ne suffit pas \u00e0 annuler la rupture conventionnelle"},"content":{"rendered":"<h2><u>Une indemnit\u00e9 insuffisante ne suffit pas \u00e0 annuler la rupture conventionnelle<\/u> (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000030872050\" target=\"_blank\">Cass. soc. 8 juillet 2015, n\u00b014-10139<\/a>)<\/h2>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Dans cet arr\u00eat, la Cour de cassation pr\u00e9cise qu\u2019une indemnit\u00e9 de rupture conventionnelle inf\u00e9rieure \u00e0 l\u2019indemnit\u00e9 l\u00e9gale et une date de rupture ant\u00e9rieure \u00e0 la date d\u2019homologation ne peuvent entra\u00eener la nullit\u00e9 de la convention de rupture.<\/p>\n<p style=\"text-align: justify;\">La tendance de la Cour de cassation en mati\u00e8re de s\u00e9curisation des ruptures conventionnelles se confirme. Seule la fraude ou le vice du consentement entra\u00eene l\u2019annulation d\u2019une rupture conventionnelle.<\/p>\n<p style=\"text-align: justify;\">Dans cette affaire, un salari\u00e9 avait conclu avec son employeur une rupture conventionnelle.\u00a0 A la suite de deux refus d\u2019homologation, les parties ont finalement sign\u00e9 le 26 juillet 2010, une troisi\u00e8me rupture conventionnelle fixant la date de la rupture le 6 aout 2010. Cette convention de rupture est homologu\u00e9e le 9 aout 2010. Le salari\u00e9 a alors saisi le Conseil de Prud\u2019hommes pour faire annuler la rupture conventionnelle.<\/p>\n<p style=\"text-align: justify;\">La Cour de cassation a estim\u00e9 que <em>\u00ab\u00a0la stipulation par les deux parties d&#8217;une indemnit\u00e9 dont le montant est inf\u00e9rieur \u00e0 celle pr\u00e9vue par l&#8217;article L. 1237-13 du code du travail\u00a0\u00bb<\/em> et <em>\u00ab\u00a0l&#8217;erreur commune de date fix\u00e9e par les parties ant\u00e9rieurement au lendemain de l&#8217;homologation n&#8217;entra\u00eenent pas, en elles-m\u00eames, la nullit\u00e9 de la convention de rupture\u00a0\u00bb<\/em>.<\/p>\n<p style=\"text-align: justify;\">Par voie de cons\u00e9quence, il appartient \u00e0 la Cour d&#8217;appel, saisie de demandes en annulation et en paiement de sommes, \u00ab\u00a0<em>de rectifier la date de la rupture et de proc\u00e9der, en cas de montant insuffisant de l&#8217;indemnit\u00e9 de rupture conventionnelle, \u00e0 une condamnation p\u00e9cuniaire\u00a0\u00bb.<\/em><\/p>\n<p style=\"text-align: justify;\">A travers cette d\u00e9cision de la Cour de cassation, deux points se d\u00e9gagent\u00a0:<\/p>\n<p style=\"text-align: justify;\">&#8211; Concernant le montant de l\u2019indemnit\u00e9 sp\u00e9cifique qui est insuffisant, l\u2019employeur est tenu de verser un compl\u00e9ment\u00a0;<\/p>\n<p style=\"text-align: justify;\">&#8211; Concernant l\u2019erreur dans la date de rupture\u00a0; Il appartient au juge de rectifier la date en la fixant au lendemain de cette homologation.<\/p>\n<p style=\"text-align: justify;\">Il convient de souligner que l\u2019article L1237-13 du Code du travail pr\u00e9voit que\u00a0le montant de l&#8217;indemnit\u00e9 sp\u00e9cifique de rupture conventionnelle ne peut pas \u00eatre inf\u00e9rieur \u00e0 celui de l&#8217;indemnit\u00e9 l\u00e9gale.<\/p>\n<p style=\"text-align: justify;\">Par ailleurs, la date de rupture du contrat ne peut pas intervenir avant le lendemain du jour de l&#8217;homologation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Une indemnit\u00e9 insuffisante ne suffit pas \u00e0 annuler la rupture conventionnelle (Cass. soc. 8 juillet 2015, n\u00b014-10139) &nbsp; Dans cet arr\u00eat, la Cour de cassation pr\u00e9cise qu\u2019une indemnit\u00e9 de rupture conventionnelle inf\u00e9rieure \u00e0 l\u2019indemnit\u00e9 l\u00e9gale et une date de rupture ant\u00e9rieure \u00e0 la date d\u2019homologation ne peuvent entra\u00eener la nullit\u00e9 de la convention de rupture.
