{"id":905,"date":"2015-04-05T21:45:31","date_gmt":"2015-04-05T20:45:31","guid":{"rendered":"https:\/\/www.garcia-avocat-paris.fr\/licenciement?page_id=905"},"modified":"2023-03-18T12:26:02","modified_gmt":"2023-03-18T11:26:02","slug":"licenciement-verbal","status":"publish","type":"page","link":"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/licenciement-verbal\/","title":{"rendered":"Licenciement verbal"},"content":{"rendered":"<header><\/header>\n<h2 style=\"text-align: justify;\"><em>Le Licenciement verbal<\/em><\/h2>\n<p style=\"text-align: justify;\">Il y a licenciement verbal lorsque l\u2019employeur met fin au contrat de travail de mani\u00e8re orale.<\/p>\n<p style=\"text-align: justify;\">Le Code du travail pr\u00e9voit que le licenciement ne peut avoir lieu sans avoir \u00e9t\u00e9 pr\u00e9c\u00e9d\u00e9 d\u2019un entretien pr\u00e9alable.<img decoding=\"async\" class=\"alignright wp-image-906\" src=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Licenciement-verbal-450x253.jpg\" alt=\"Un homme licencie son employ\u00e9 verbalement; avocat en licenciement verbal\" width=\"251\" height=\"141\" srcset=\"https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Licenciement-verbal-450x253.jpg 450w, https:\/\/www.garcia-avocat-paris.fr\/licenciement\/wp-content\/uploads\/2015\/04\/Licenciement-verbal.jpg 480w\" sizes=\"(max-width: 251px) 100vw, 251px\" \/><\/p>\n<p style=\"text-align: justify;\">Le salari\u00e9 qui est licenci\u00e9 sans avoir \u00e9galement eu par \u00e9crit la notification de la lettre de licenciement fait l\u2019objet d\u2019un licenciement verbal.<\/p>\n<p style=\"text-align: justify;\">La Cour de cassation pr\u00e9cise que \u00ab\u00a0<em>le licenciement verbal, malgr\u00e9 son irr\u00e9gularit\u00e9, entra\u00eene la rupture du contrat de travail et fixe le point de d\u00e9part du pr\u00e9avis<\/em>\u00a0\u00bb (<em>Cass. soc., 12\u00a0mars\u00a01992, n<sup>o<\/sup>\u00a090-44.174<\/em><em>, RJS 4\/92, n<sup>o<\/sup>\u00a0425<\/em><em>\u00a0; Cass. soc., 9\u00a0avr. 1992, n<sup>o<\/sup>\u00a090-42.335).<\/em><\/p>\n<p style=\"text-align: justify;\">Le salari\u00e9 doit prouver le licenciement verbal. La preuve est parfois difficile \u00e0 rapporter. Elle peut \u00eatre faite par tout moyen, y compris par un constat d\u2019huissier.
