En revanche, la rupture du contrat r\u00e9sultant de l&#8217;initiative de l&#8217;employeur constitue un licenciement.<\/p>\n<p style=\"text-align: justify;\">Motifs et proc\u00e9dures de licenciement sont fortement li\u00e9s. Le choix du motif par l&#8217;employeur d\u00e9termine le type de proc\u00e9dure applicable. Tout licenciement doit \u00eatre justifi\u00e9 par une cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p style=\"text-align: justify;\">L\u2019employeur qui envisage de licencier le salari\u00e9 doit \u00eatre en mesure de justifier de la r\u00e9alit\u00e9 et du s\u00e9rieux du motif qui l&#8217;a conduit \u00e0 engager la proc\u00e9dure de licenciement. L\u2019<strong><em>avocat licenciement<\/em><\/strong> va alors v\u00e9rifier si les griefs contenus dans la lettre de licenciement sont justifi\u00e9s et peuvent fonder le licenciement\u00a0: la faute commise par le salari\u00e9 est-elle proportionnelle \u00e0 la sanction\u00a0? Des circonstances peuvent-elles justifi\u00e9es la faute commise et l\u2019excuser\u00a0?
